Terms of Use

These Terms of Use ("Terms") govern your use of the Penna mobile app (the "App"), provided by Moose Media LLC ("we", "us", "our"). By installing or using the App you agree to these Terms. If you don't agree, please don't use the App.

1. The Service

Penna lets you take or pick a photo and convert it into a printable coloring page using our AI-generation service. The App is provided "as is" without warranties of any kind.

2. Accounts

You can use most of the App's features without creating an account. If you choose to create an account, you're responsible for keeping your password secure and for all activity that happens under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Your photos and your output

You retain all rights to the photos you upload and to the coloring pages you generate. We do not claim ownership of your content.

Photos you upload are processed in real time and immediately discarded from our servers. We do not retain copies. The resulting coloring pages are delivered to your device and stored there.

By using the App you confirm that you have the right to upload the photos you submit (i.e. you took them or have permission from the people who appear in them).

4. Acceptable use

You agree not to use the App to:

• upload illegal content, including content that depicts minors in a harmful way;
• infringe anyone else's copyright, trademark, or privacy rights;
• attempt to extract, reverse-engineer, or scrape our service;
• circumvent rate limits, fraud-prevention measures, or paid-tier restrictions;
• use the App for unlawful purposes or in violation of any applicable law.

5. Subscriptions and payments

The App offers optional subscription plans that unlock unlimited coloring page creation. All purchases are processed by Apple App Store or Google Play Store under their respective terms. Subscriptions auto-renew until cancelled; you can manage or cancel your subscription at any time through your App Store / Play Store account settings. Refunds are handled by Apple or Google according to their policies.

Without a subscription, the App provides a limited number of free coloring page creations on a periodic schedule. The exact number and refill cadence may change from time to time as we tune the free tier.

6. Intellectual property

The Penna name, logo, app design, and underlying software are owned by Moose Media LLC. You don't get any rights to them by using the App, beyond the limited license to use the App itself for its intended purpose.

7. Disclaimers

The App is provided "as is" and "as available" without any warranties, express or implied. We don't guarantee that the generated coloring pages will meet your expectations, that the service will always be available, or that it will be error-free. AI-generated output is sometimes unexpected — that's the nature of the technology.

8. Limitation of liability

To the maximum extent permitted by law, Moose Media LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App. Our total liability for any claim related to the App is limited to the amount you've paid us in the twelve months preceding the claim (or USD 50 if you haven't paid anything).

9. Changes

We may update these Terms from time to time. Material changes will be announced in-app on first launch after the change. Continued use of the App after a change means you accept the updated Terms.

10. Termination

You can stop using the App at any time by uninstalling it. We can terminate or suspend your access if you breach these Terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability) will continue in effect.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. If a dispute arises, the courts of Wyoming have exclusive jurisdiction, except where applicable law (e.g. EU consumer protection law) gives you a right to bring proceedings in your country of residence.
